Topic: Recent Advocate General’s Opinion in the DNO Yémen AS case before the CJEU, issued on 19 March 2026 (C-842/24), and its practical consequences for arbitration proceedings.
AG Szpunar’s Opinion in DNO Yémen AS (C-842/24) addresses key questions on the standard and burden of proof in arbitration and annulment proceedings in the sanctions context — notably that the interpretation of EU restrictive measures should not be driven by domestic evidentiary rules. On the merits, the Opinion advocates for a broad interpretation of “making funds available”: payments to non-designated entities may still be prohibited where there is a reasonable risk that those funds will ultimately benefit a sanctioned individual or entity.
