The ECBA joined call for the implementation of European Court of Human Rights / Cour européenne des droits de l’homme (ECtHR) and Court of Justice of the European Union (CJEU) judgments
The European Criminal Bar Association (ECBA) co-signed a joint letter by Democracy Reporting International (DRI) and the European Implementation Network (EIN), addressed to the incoming Cypriot Presidency of the Council of the EU.
The core of our message: The rule of law and the protection of fundamental rights in Europe depend entirely on the enforcement of judicial decisions. We are urging the Presidency to place the non-implementation of European ECtHR and CJEU judgments on the formal agendas of the General Affairs Council and the Justice and Home Affairs Council.
As criminal defence lawyers across Europe, we know that a judgment is only as strong as its execution. Failure to implement these rulings undermines the European legal order and the rights of every individual.
