Topic: Recent CJEU’s judgment in the OP case, issued on 20 March 2025 (C 763/22), and its practical consequences for conflicting third-state extradition requests.
The CJEU’s judgment in OP (C‑763/22) addresses key questions on the conflict between an EAW and an extradition request — notably that while an executive body may take a decision granting precedence to one instrument under Art. 16(3) FD-EAW, there must be an effective judicial remedy against that decision. This judgement offers further indication of the need to empower the defence to intervene in extradition to third States cases (viz., Petruhhin-type cases), which in turn contributes to free movement and equal treatment within the EU.
